How should we address any legal/regulatory questions regarding students doing work-based learning experiences and when should we conduct CORI checks on the employers and their employees who are involved with internships?
You should address these questions at the district level, considering relevant district policy and involving district counsel as needed. Employers may also have specific legal/regulatory concerns to address before welcoming students as interns. M.G.L. c. 71, § 38R requires all schools to conduct criminal background checks on current and prospective employees and volunteers, including those who regularly provide school related transportation to students, who may have direct and unmonitored contact with children. CORI must be obtained from the CHSB at least every three years during an individual’s term of employment or service.
